MEMBERSHIP TERMS AND CONDITIONS:
PLEASE READ CAREFULLY

This Membership Agreement is between the Member whose details are on the front page (you) and OLYMPIC GYM 2019 LIMITED trading as OLYMPIC GYM (we, us). You may cancel your Membership Agreement by emailing us at reception@olympicgym.co.nz within 5 working days of your Membership Agreement being accepted, payment for use of gym may be required.

01. USE OF THE GYM

Your membership gives you the right to use the gym facilities during opening hours of the Olympic Gym. It does not cover additional costs like food or drink, Physiotherapy or personal training, which you must pay for separately. We will take all reasonable care to ensure that facilities are available during normal opening hours, but sometimes demand from other members or circumstances beyond our control such as equipment failure may mean that the equipment you want to use may not be available.

02. MEMBERSHIP PERIOD

You agree to join Olympic Gym for the minimum period as specified on your Membership Agreement and agree to make regular payments on time for the duration of this period (even if you are not attending the Gym). After your minimum period ends, regular payments will continue until your Membership Agreement is terminated in accordance with section 05 ‘Termination of this Contract by you’.

03. FEES AND PAYMENTS

You agree to pay all the payments as shown on the front page. You must continue paying even if you do not use the gym. A valid photo student ID must be shown before any student membership is accepted. During the initial (minimum) period membership you can only cancel or transfer your membership as set out in these Terms and Conditions (see Termination by you below). After the initial period, payments will continue until you advise us of your cancellation or successful transfer of this agreement (see “How to Cancel” below).The membership rate quoted is a weekly rate and must be paid by weekly direct debits or in full at start of contract. It is your responsibility to make sure there are sufficient funds in your account. A direct debit form must be signed before your membership is accepted and you begin attending Olympic Gym. If you change your account, you also agree to notify us and complete a replacement direct debit form. When payment(s) are missed, you may not be able to enter the gym until you have paid any overdue balance. If you do not pay at the gym, any overdue amount will be added to your next Direct Debit. All costs associated with recovery of any missed payments will be added to any amounts due. This may include a $5 administration charge. No refunds for unused time will be given. If your account with us is more than 4 weeks in arrears, please understand that your details may be sent to a collection agency and that you agree to pay all our reasonable collection costs, including actual legal fees.

04. GYM RULES AND PROCEDURES

You must comply with gym rules and procedures at all times while using the gym. These rules and procedures are designed to allow all members to get maximum benefit from their membership and may change from time to time. Copies are available at the front desk and online at www.olympicgym.co.nz You must not carry out any illegal acts on gym premises and you must comply with our health and safety requirements. You must respect staff and other members, and you must not take photographs or videos in the gym without our permission and the permission of every person in the photograph or videos. Any breaches of gym rules may result in termination of your Membership Agreement, we may also seek compensation for any costs incurred, including legal costs on a solicitor-client basis. 05. TERMINATION OF THIS CONTRACT BY YOU

If you choose to terminate your contract within the initial term, you must provide at least 5 business days prior written notice of this intention. You can request to terminate your membership by emailing us at Reception@olympicgym.co.nz. When we receive your request, we will reply in writing to finalize the process. If you choose to terminate your Membership Agreement before the end of your minimum period, you must pay a termination fee of 35% of the balance of the membership fees you are contracted to pay for your full minimum term, up to a maximum fee of $370 (Termination Fee) to cover our losses. No termination fee will apply if you choose to terminate after the end of your minimum period. Alternatively, you can ask us to transfer your membership to another person with our consent for the remainder of the initial term providing you pay a transfer administration fee of $25.00 and that person complies with our usual membership requirements. It is your sole responsibility to find the person to transfer your membership to.

05. TERMINATION OF THIS CONTRACT BY US

We may terminate your membership immediately if you carry out any activity which we reasonably consider to be illegal, offensive, dangerous to other people or to you, if you act in serious breach of gym rules, or if at any time four or more payments are overdue. If we terminate because of your actions, we will not be liable to you in any way.

06. PAUSING MEMBERSHIP

During the initial term you can suspend your membership and your payments as set out in the front page. Each pause must be for at least 2 weeks. Your initial period will be extended by the length of pause. After the minimum term you can suspend your membership by a maximum of 1 month in any period of 12 months of gym use. If you use the gym during a pause period, your payments will restart immediately.

07. HOW TO CANCEL

After the initial period you may cancel your membership by informing Olympic Gym in person at the Gym, or in writing which may be by email.Confirmation letters/emails/texts will be sent within seven days of receiving a cancellation request. Cancellation will take effect from your next direct debit date that is more than 10 working days after we receive your request

08. GOVERNMENT RESTRICTIONS AND MANDATES

To comply with the New Zealand Government's requirements in respect of a pandemic such as COVID-19, there may be requirements in accordance from the Ministry of Health as a condition of utilising your membership. If any requirements are mandated, we may require satisfactory proof any such requirements have been met upon entry into Olympic Gym. This information will be held securely and otherwise in accordance with our Privacy Policy.

09. GENERAL

We may need make changes to this membership agreement from time to time. We will give you one month’s notice of any changes using email/text. Where we reasonably believe that a change will be detrimental to you (unless it is required by law) and you are still within the initial period we will offer you the right to cancel the contract. It is your responsibility to use this gym safely, to take care of your own health and to take care of your own property. Personal injury by accident in New Zealand is covered by the Accident Compensation Act.
